Rate for Transportation Pooling Service

Applicability

This service is available to any industrial customer whose total consumption for the most recent twelve (12) billing periods, or estimated future annual consumption for those customers without sufficient billing history, is greater than 900,000 Therms, and whose premises are located adjacent to the distribution mains of the company suitable for this service. Industrial customers with multiple locations within the company's service territory may total the gas used at their various locations to meet the 900,000 Therms minimum consumption requirement, even though some locations may be billed at the company's large industrial rate and other locations at the small industrial rate.

This service is also available to any customer whost total annual consumption has been, or is expected to be, greater than 10,000 Therms and is using natural gas for space cooling.

This rate schedule is applicable to gas transportation service. Service under this schedule will be supplied only to customers (i) having their own gas supply, or having gas acquired on their behalf, (ii) having all required regulatory approvals relating to the transportation and use of such gas, and, (iii) entering into a written transportation contract with the company.

Character of Service

Transportation service under this schedule shall be Firm Service and shall be billed separately from service rendered under any other rate schedule.

The customer shall arrange for delivery of gas to the Company at the City Gate. All gas received by the Company for transportation service shall be metered at the City Gate, along with general system supply volumes, and at the customer's premises, using existing metering equipment. The customer's gas supply shall be the first gas delivered each day that service is provided under this schedule.

Contract

Any Customer requesting service under this Rate Schedule shall enter into a written contract with the Company for such period as shall be mutually agreeable to the parties, and such contract shall continue from year to year thereafter, unless canceled by either party giving the other six (6) months prior written notice.

Rate

Large Commercial Rate: $0.10658 per Therm, plus the Take-or-pay Surcharge as shown on Appendix A

Public Authority Rate: $0.08262 per Therm, plus the Take-or-pay Surcharge as shown on Appendix A

Large Industrial Rate: $0.05395 per Therm, plus the Take-or-pay Surcharge as shown on Appendix A

Small Industrial Rate: $0.08233 per Therm, plus the Take-or-pay Surcharge as shown on Appendix A

In addition to the rate set out above, the customer shall have paid the customer charge for his applicable rate class.

Late Payment Charge and Application on Delinquent Bills

Bills shall be rendered and due monthly. If paid within seventeen (17) days from the mailing date thereof, or the due date as stated in the bill, the net bill shall be the amount to be paid. If not paid within the due date thereof as stated in the bill, the gross bill, which includes the collection charge of three percent (3%) of the net bill, shall be the amount to be paid. When the due date falls on Saturday, Sunday or any legal holiday, the first business day thereafter shall be added to the seventeen- (17-) day period.

Nonsufficient Funds Checks

A charge will be made to reimburse the Company for its cost in handling a Customer's check returned by any bank for nonsufficient funds, which charge shall be eighteen dollars ($18.00).

Rules

Service hereunder shall be subject to Company's Rules and Regulations and the Rules and Standards of Service for Gas Public Utilities prescribed by the Indiana Utility Regulatory Commission from time to time.
